**Preamble**
These General Terms and Conditions govern the remote purchase of products via the website **WWW.OILIVIS.IT**, owned by **OILIVIS S.R.L.**, with legal headquarters at **Via Giulio Andreotti, 2 – 71010 Carpino (FG)**, VAT No. **04399470717**.

Purchases are regulated by **Legislative Decree No. 185 of 22/05/1999**, while privacy protection follows **Legislative Decree 196/2003**. These terms are valid from **15/09/2015** and may be updated or modified at any time without prior notice. Changes will take effect upon publication on **WWW.OILIVIS.IT**. The Customer is responsible for reviewing and storing updated versions.

An **online sales contract** is defined as a distance contract between **OILIVIS S.R.L.** and a consumer, using the Internet as the exclusive remote communication technology. A **consumer** is any natural or legal person purchasing goods/services for purposes not directly related to professional activities.

**Article 1 – Acceptance of Sales Conditions**
1.1 The terms outlined in the Preamble are integral to this contract.
1.2 Contracts are concluded when the Customer accesses **WWW.OILIVIS.IT** and completes the purchase procedure.
1.3 The Customer must review these General Terms before finalizing the purchase. Order confirmation implies full acceptance.
1.4 By submitting the order, the Customer unconditionally accepts these terms and acknowledges that **OILIVIS S.R.L.** is not bound by any other conditions unless agreed in writing.
1.5 If the Customer cancels an already accepted order, any deposits paid will be retained as partial compensation, without prejudice to **OILIVIS S.R.L.**’s right to claim further damages.

**Article 2 – Purchase Conditions & Methods**
2.1 All product prices on **WWW.OILIVIS.IT** are **exclusive of 22% VAT**.
2.2 Shipping costs are borne by the Customer unless otherwise specified. These costs will be displayed before purchase confirmation.
2.3 The purchase contract is finalized upon online order confirmation after registration.
2.4 Payment can be made using the methods indicated at checkout.
2.5 Shipping costs vary based on weight, dimensions, and destination.
2.6 **OILIVIS S.R.L.** reserves the right to modify prices at any time to align with supplier pricing policies.

**Article 3 – Delivery Methods**
3.1 **OILIVIS S.R.L.** will arrange delivery via courier to the address provided by the Customer.
3.2 Goods will be delivered within the timeframe specified under **Art. 6 of Legislative Decree 185/1999**. No liability is assumed for delays due to force majeure.
3.3 The Customer must verify product conformity upon delivery.
3.4 Any discrepancies must be reported on the delivery document and confirmed within **7 days** via fax or registered mail. Hidden defects must also be reported in writing within **7 days**.
3.5 Deliveries occur **Monday–Friday, 8:30 AM–12:30 PM and 2:00 PM–6:00 PM** (non-holidays), ground floor only unless otherwise agreed.
3.6 The Customer must ensure availability during delivery hours to avoid additional courier fees.
3.7 **OILIVIS S.R.L.** is not liable for damage caused by the courier.

**Article 4 – Product Availability**
4.1 Only products listed in the **OILIVIS S.R.L.** online catalog are available for purchase. If an order exceeds stock, the Customer will be notified of availability.

**Article 5 – Liability**
5.1 **OILIVIS S.R.L.** is not liable for disruptions caused by **force majeure** (e.g., accidents, strikes, natural disasters).
5.2 The Customer’s sole remedy in such cases is a refund of the amount paid.
5.3 **OILIVIS S.R.L.** is not responsible for fraudulent use of credit cards or other payment methods, as it does not process payment details directly.

**Article 6 – Assistance & Warranty**
Our products meet the highest quality standards, and storage/shipping methods ensure preservation. All products are covered by a warranty for defects, to be reported within **8 days of discovery**. We will replace the product or refund the amount paid, including shipping costs, per **Articles 1519 quater and sexies of the Italian Civil Code**.

**Article 7 – Customer Obligations**
7.1 The Customer must print and retain these Terms and product specifications.
7.2 Updated terms will be published on **WWW.OILIVIS.IT**, and the Customer must review them.
7.3 Providing false or third-party data during registration is strictly prohibited.
7.4 Multiple registrations under one person or using third-party data will result in legal action.
7.5 The Customer is solely responsible for correct tax document details.

**Article 8 – Returns**
8.1 Returns are only accepted with prior written authorization and must be in original packaging with the invoice and a return note.
– If the return is due to a **Customer error**, **50% of the invoice total** will be withheld as a restocking fee.
– If the return is due to an **OILIVIS S.R.L. error**, replacement and shipping costs will be covered.

**Article 9 – Payment Authorization**
9.1 By completing checkout, the Customer authorizes **OILIVIS S.R.L.** to charge the total purchase amount via the selected payment method. Transactions are processed securely by the bank.

**Article 10 – Contract Termination & Resolutive Clause**
10.1 **OILIVIS S.R.L.** may terminate the contract with written notice, refunding any amounts paid.
10.2 Customer breaches (e.g., payment failure) will result in automatic termination per **Art. 1456 of the Italian Civil Code**, without judicial intervention.

**Article 11 – Privacy**
11.1 Personal data is processed electronically for order and shipping management, in compliance with **Legislative Decree 196/03**. Data will **not** be shared with third parties outside **OILIVIS S.R.L.**
11.2 Customers may opt in/out of marketing communications by emailing **info@oilivis.it**.
11.3 Data may be shared only with parties necessary for contract execution.
11.4 Customers have the right to access, rectify, or delete their data under **Art. 13 of Law 675/1996**.
11.5 Data deletion requests must be submitted in writing to **OILIVIS S.R.L.**

**Article 12 – Jurisdiction & Competent Court**
12.1 Disputes are governed by **Italian law** (Legislative Decrees 50/1992 and 185/1999).
12.2 The exclusive jurisdiction for disputes is the **Court of Foggia**.

**Article 13 – Retention of Title**
13.1 Goods remain **OILIVIS S.R.L.** property until full payment. The Customer may not resell, pledge, or transfer goods until debt settlement.
13.2 In installment sales, ownership transfers upon final payment.
13.3 The Customer must maintain goods in perfect condition until full payment (**Art. 1768 Italian Civil Code**).
13.4 **OILIVIS S.R.L.** may reclaim goods in case of payment delays, insolvency, or financial distress.
